DWX is committed to the "good neighbor" policy concerning Internet traffic into and out of our Network. DWX therefore asserts its Policy On Acceptable Use as a means of protecting its network, service, customers and fellow members of the Internet community. DWX reserves the right to interpret and/or alter this policy as warranted or deemed necessary by DWX administration. As this policy cannot address every conceivable situation or conflict that may arise, any actions or activities not covered here or about which there is doubt should be directed to support@dwx.com for evaluation.
Statement of Responsibility
- All DWX accounts (On-Demand Dialup, Personal and Corporate Web Hosting, Mailbox, UUCP etc.) are assigned a unique password which is required to gain access to any and all services. The DWX client who initially registered a given account is solely responsible for all access and actions taken with regard to the account. It is therefore the responsibility of the account's owner to safeguard the account password and to ensure that all DWX Acceptable Use Policies are honored. In the event that DWX Acceptable Use Policies are violated, DWX will hold the account owner responsible for said violations.
- Networks directly connected to the DWX backbone (DWX Direct, Frame-Relay, Dedicated PPP etc.) are required to adhere to DWX Acceptable Use Policies as well. The officer who initially signed the contract with DWX (or his/her replacement) is responsible for educating network users on acceptable use policies. Violations of DWX Acceptable Use Policies by directly connected networks will be referred to the contract signer for rectification. The contract signer will be held responsible for any violations of DWX Acceptable Use Policies.
Acceptable Use: General - System
Acceptable use of DWX Network facilities does NOT include:
- Attempting to circumvent user authentication or security of any host, network, or account on DWX systems or the Internet at large. This includes (but is not limited to) attempts to logon to remote or local systems under another user's identity, attempting to retrieve mail belonging to other users, etc.)
- Use of DWX systems or networks (willfully or negligently) in such a manner as to encumber disk space, processors, bandwidth, or other system resources or to interfere with others' normal use of services on DWX or other systems and networks. This includes (but is not limited to) any sort of email, "flood", "ping", "list-serve" or icmp attack.
- Activities which violate local, state, or federal statutes. This includes (but is not limited to) the distribution or redistribution of software or any other licensed product without the express written consent of its rightful owner or creator.
Acceptable Use: Email
Acceptable use of Email does NOT include:
- Sending unsolicited mass mailings of any nature, including those with a "negative option" for continuation. The negative option is inviting those who do not wish to receive more email to reply to you.
- Sending a large number of email messages, or singularly large email messages, to a single address in order to "flood" someone's mailbox or to encumber the mail server at the user's provider.
- Forging email headers to obscure the true originator of the message.
- Sending harassing email, either by language, size, or frequency. This includes (but is not limited to) sending email messages to a person who has requested explicitly that you not do so.
- Activities which violate local, state, or federal statutes.
Acceptable Use: Usenet
Acceptable use of DWX Usenet News service does NOT include:
- Posting unsolicited messages to a large number of Usenet newsgroups either by cross-posting or posting to individual groups ("spamming").
- Attempting to cancel, supersede, or otherwise interfere with Usenet posts other than one's own.
- Blatant posting of articles which violate the named charter for specific newsgroups.
- Publishing someone's real-world data (such as phone number, address, social security number, etc.) in such a way as to cause the person trouble or to incite others to do so.
- Forging Usenet header information to obscure the true originator of the message.
- Activities that violate local, state, or federal statutes.
Acceptable Use: Dial-up Access
- Dial-up connections to DWX that are idle for 15 minutes or longer, or connected for more than 24 hours continuously, will be disconnected. Idle time is defined as a period during which no input or output is sent or received across the modem connection.
- Multiple simultaneous logins to a single DWX On-Demand dial-up account are prohibited.
- While DWX On-Demand service offers unlimited access to the Internet, it is not a dedicated modem connection. Dedicated modem connections are a separate product. If interested in a dedicated modem connection, please contact the DWX Sales Staff.
Use of DWX On-Demand dial-up service as a dedicated modem connection through use of redialers, auto-dialiers and idle-time traffic generators is prohibited.
Acceptable Use: World-Wide Web - FTP space
Acceptable use of DWX Personal Web - FTP space does NOT include:
- Distribution of restricted software or materials in violation of copyrights or distribution licenses. This includes (but is not limited to) "warez" or pirated software, images or "cracking" tools.
- Distribution of materials which violate local, state, or federal statutes.
Spamming
- DWX customers, and customers of DWX customers or any user of bandwidth and/or services on our network (herein described as 'users') are prohibited from sending UBE/UCE (unsolicited bulk email/unsolicited commercial email). Users may be asked to produce records that verify that explicit affirmative permission was obtained from a recipient before a mailing was sent. DWX may consider the lack of such proof of explicit affirmative permission of a questionable mailing UBE/UCE at its sole discretion.
- DWX customers are prohibited from maintaining open mail relays on their servers. Ignorance of the presence or operation of an open mail relay will not be considered an acceptable excuse for its (the open mail relay) operation. Multiple infractions of this policy will result in a discontinuation of service.
- DWX customers will be notified in the event that they may be hosting sites listed as violators of the above policy. Failure to rectify such situations may be cause for termination.
- DWX customers are prohibited from providing hosting services for websites that have been included in UBE/UCE. Hosting includes, but is not limited to, hosting website(s), providing DNS services as well as website redirect services.
- Valid complaints received by DWX may lead to immediate termination or suspension of the service. DWX may block traffic without prior notice to and from the IP address involved in the UBE/UCE complaint until the problem is resolved and preventative measures have been implemented to prevent the violation from recurring.
- DWX reserves the right to suspend and/or cancel permanently any and all services provided to the user without a notification. If a Customer is in violation of any term or condition of this Spamming Policy, the Acceptable Use Policy. User Agreement or Customer's use of the Service disrupts or, in DWX's judgment, could disrupt, DWX's business operations.
DWX reserves the right to restrict or terminate service without notice and without refund in the event of an AUP violation. DWX also reserves the right to take action on abuse not specifically named in this statement of Acceptable Use Policies at the sole discretion of DWX Administration.
Use of the DWX networks, systems and facilities systems constitutes understanding of and agreement to DWX Acceptable Use Policies.
